Regardless of the previous paragraph, if NNDS is found to be liable, NNDS' liability to you or any third party is limited to the greater of (a) the total fees you paid to NNDS in the 6 months prior to the action giving rise to the liability, and (b) $100.
You release NNDS (and our officers, directors, agents, subsidiaries, joint ventures and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with the NNDS website.
You will indemnify and hold NNDS (and our officers, directors, agents, subsidiaries, joint ventures and employees), harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of this website, or your violation of any law or the rights of a third party.
No agency, partnership, joint venture, employee-employer or franchiser-franchisee relationship is intended or created by this Agreement.
The Terms and Conditions will be governed by and construed in accordance with the laws of the State of Nevada, without giving effect to the conflict of laws provisions of Nevada or your actual state or country of residence. If for any reason a court of competent jurisdiction finds any provision or portion of these terms and conditions to be unenforceable, the remainder of these terms will continue in full force and effect. These terms and conditions constitute the entire agreement between the parties with respect to the subject matter hereof and supersede and replace all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter. Any waiver of any provisions of these terms and conditions will be effective only if in writing and signed by NNDS officer. NNDS reserves the right to modify or change these terms and conditions from time to time.
